{"id":874,"date":"2018-02-22T15:53:40","date_gmt":"2018-02-22T14:53:40","guid":{"rendered":"http:\/\/unsa-fnacdarty.org\/?p=874"},"modified":"2018-04-30T17:08:07","modified_gmt":"2018-04-30T15:08:07","slug":"harmonisation-attention-danger","status":"publish","type":"post","link":"http:\/\/unsa-fnacdarty.org\/?p=874","title":{"rendered":"HARMONISATION : ATTENTION DANGER"},"content":{"rendered":"\t\t<div data-elementor-type=\"wp-post\" data-elementor-id=\"874\" class=\"elementor elementor-874 elementor-bc-flex-widget\">\n\t\t\t\t\t\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-20848f1c elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"20848f1c\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-559398e0\" data-id=\"559398e0\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-3ccb6ddd elementor-widget elementor-widget-text-editor\" data-id=\"3ccb6ddd\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p><span style=\"color: #000000;\">La n\u00e9gociation entre les syndicats et la Direction de FDPS pour \u00ab\u00a0l&rsquo;harmonisation\u00a0\u00bb des statuts des salari\u00e9s ex-Fnac SA et ex-Darty SNX a commenc\u00e9 le mercredi 31 janvier 2018.<\/span><\/p><p><span style=\"color: #000000;\">Le terme \u00ab\u00a0Harmonisation\u00a0\u00bb est trompeur : il ne s\u2019agit pas \u00ab\u00a0d\u2019harmoniser\u00a0\u00bb mais de <span style=\"color: #10afda;\"><strong>revoir \u00e0 la baisse les acquis des salari\u00e9s des deux entit\u00e9s<\/strong> <\/span>pour limiter les co\u00fbts.<\/span><\/p><p><span style=\"color: #000000;\">\u00a0<\/span><\/p><p><span style=\"color: #a4107f;\"><strong>CE QUI AURAIT DU SE PASSER<\/strong><\/span><\/p><p><span style=\"color: #10afda;\"><strong>Le Droit pr\u00e9voit que les salari\u00e9s nouvellement int\u00e9gr\u00e9s acqui\u00e8rent automatiquement les statuts, usages et accords en cours dans l&rsquo;entreprise qui les re\u00e7oit.<\/strong><\/span><\/p><p><span style=\"color: #000000;\">A l\u2019issue de l\u2019accord de transition, au 1er mai 2018, <span style=\"color: #10afda;\"><strong>l&rsquo;int\u00e9gralit\u00e9 des salari\u00e9s ex-SNX aurait ainsi pu b\u00e9n\u00e9ficier, sans restriction, des accords en vigueur chez Fnac SA<\/strong><\/span>. Pour les salari\u00e9s concern\u00e9s, cela aurait permis, entre autres, de b\u00e9n\u00e9ficier :<\/span><\/p><ul><li><span style=\"color: #000000;\"><strong>Automatiquement d&rsquo;un treizi\u00e8me mois de salaire (m\u00eame si la Direction pr\u00e9tend le contraire en avan\u00e7ant une interpr\u00e9tation honteusement abusive de l&rsquo;article de la convention d&rsquo;entreprise Fnac SA concern\u00e9),<\/strong><\/span><\/li><li><span style=\"color: #000000;\"><strong>de la prime de vacances (d&rsquo;un montant de 753 euros bruts en 2017),<\/strong><\/span><\/li><li><span style=\"color: #000000;\"><strong>d\u2019une sixi\u00e8me semaine de cong\u00e9s pay\u00e9s pour les cadres,<\/strong><\/span><\/li><li><span style=\"color: #000000;\"><strong>du calcul des primes d&rsquo;anciennet\u00e9 version Fnac SA, bien plus avantageux que celui en vigueur chez Darty,<\/strong><\/span><\/li><li><span style=\"color: #000000;\">Liste non exhaustive&#8230;<\/span><\/li><\/ul><p><span style=\"color: #000000;\">Les salari\u00e9s auraient par ailleurs <span style=\"color: #10afda;\"><strong>conserv\u00e9 tous les \u00e9l\u00e9ments actuels de r\u00e9mun\u00e9ration<\/strong> <\/span>mentionn\u00e9s sur leur contrat de travail : part variable, PFA (Prime de Fin d&rsquo;Ann\u00e9e), etc.<\/span><\/p><p><span style=\"color: #10afda;\"><strong>Pour les salari\u00e9s Fnac SA, il ne se serait rien pass\u00e9, ce qui reste mieux que de perdre certains avantages.<\/strong><\/span><\/p><p><span style=\"color: #10afda;\"><strong>\u00a0<\/strong><\/span><\/p><p><span style=\"color: #a4107f;\"><strong>H\u00c9LAS POUR LES SALARI\u00c9S, CE N&rsquo;EST PAS CE QUI VA SE PASSER<\/strong><\/span><\/p><p><span style=\"color: #000000;\">Faire passer les ex-SNX sous statut Fnac aurait co\u00fbt\u00e9 de l\u2019argent, et la Direction ne souhaite pas d\u00e9penser d\u2019argent suppl\u00e9mentaire pour ses salari\u00e9s. Pour contourner l\u2019application stricte de la loi, deux possibilit\u00e9s\u00a0:<\/span><\/p><ul><li><span style=\"color: #000000;\">La Direction aurait pu d\u00e9cider de d\u00e9noncer unilat\u00e9ralement les Accords.<br \/><\/span><span style=\"color: #000000;\">Une p\u00e9riode de 15 mois se serait ouverte, au cours de laquelle la Direction aurait \u00e9t\u00e9 dans l&rsquo;obligation d\u2019ouvrir des n\u00e9gociations avec les Organisations Syndicales dans le but d&rsquo;aboutir \u00e0 de nouveaux accords. Pendant cette p\u00e9riode, le droit pr\u00e9voyait l\u2019application de l\u2019accord de transition jusqu\u2019au 30 avril 2018 puis passage des salari\u00e9s ex-SNX sous le r\u00e9gime des accords Fnac. En cas d&rsquo;\u00e9chec des n\u00e9gociations, et \u00e0 l&rsquo;issue du d\u00e9lai, la Direction aurait eu la possibilit\u00e9 de prendre des mesures unilat\u00e9rales.<\/span><\/li><\/ul><p><span style=\"color: #000000;\"><strong>\u00a0<\/strong><\/span><\/p><ul><li><span style=\"color: #000000;\">La Direction a pr\u00e9f\u00e9r\u00e9 <strong>\u00ab\u00a0<span style=\"color: #10afda;\">proposer\u00a0<\/span>\u00bb<\/strong> aux Organisations Syndicales de ren\u00e9gocier les accords sans passer par une d\u00e9nonciation unilat\u00e9rale.
